Chapter 5.16 AMUSEMENT MACHINES

For the purpose of this chapter, the following terms are defined as follows:
Claw, hook or grab machines means and includes any machine or device so designed that articles placed therein for the purpose of the game may be grabbed, hooked or otherwise displaced, recovered or removed by the operation of any contrivance, simulating in miniature a power shovel, clam shell or drag line, or other mechanical device operated to produce a similar result. - 5.16.020 Possession prohibited--Exception.
No person shall keep, maintain or have in his or her possession, or under his or her control in any place of business or in any place of public resort, either as owner or lessee, agent, employee, mortgagee or otherwise, any claw, hook or grab machine, the use, operation or play of which is controlled, permitted or made available by placing therein any coin, plug, disc, key or token, or which is let for use, operation or play upon the payment or delivery of anything of value therefor or upon the making of any purchase; provided that the provisions of this section shall not apply to the keeping, possessing or exhibiting of any such game or machine at or in any store or place in which such games or machines are kept solely for sale or storage when members of the public are not permitted or allowed to operate, manipulate or play such games or machines, except as incident to demonstration for the purpose of sale. - 5.16.030 Nuisance--Abatement.
Any machine, contrivance, appliance, device, game, ticket, chance, share, interest, instrument or article operated, used, kept, possessed, placed or maintained in violation of the provisions of (A) Section 330a of the State Penal Code; (B) any section enumerated in Part I, Title 9, Chapter 9 of the State Penal Code; or (C) Section 5.16.020, is declared to be a nuisance and shall be subject to abatement. - 5.16.040 Confiscation and destruction--Release.
A. Any article declared by Section 5.16.030 to be a nuisance, as a result of the operation, use, keeping, possession, placing or maintaining of which any person has been convicted or has pleaded guilty to any violation of any law of this state or of any other ordinance of this city, shall be destroyed by the chief of police after such plea or after judgment of conviction becomes final. The contents of such machine shall be destroyed, or if money, shall be deposited in the general fund of the treasury of the city.
B. If the articles subject to destruction are in the custody of the municipal court of the city, the chief of police shall cause to be made an application to a judge of the municipal court for an order releasing the articles to the chief of police for the purpose of complying with this section; provided, however, that this section shall not limit the power of the chief of police to abate such articles as public nuisances.
