- 2.48.010 Established.
A board of zoning appeals is established in and for the city. (Prior code § 3-15)
- 2.48.020 Composition.
The board shall consist of five members. (Prior code § 3-16)
- 2.48.030 Appointment--Compensation.
The members of the board shall serve without compensation and shall be appointed by a majority of the council. (Prior code § 3-17)
- 2.48.040 Terms of office.
A. The terms of office for members of the board shall be three years or until their successors shall be appointed and qualified.
B. Members of the board serving on January 1, 1962, shall continue to hold office until the expiration of the terms of their appointments. Thereafter, appointments other than appointments to complete unexpired terms shall be for three-year terms. (Prior code § 3-20)
- 2.48.050 Qualifications of members.
Each member of the board shall be a qualified elector of the city at the time of his or her appointment and during his or her incumbency. (Prior code § 3-19)
- 2.48.060 Vacancies.
Vacancies for any unexpired term in the board shall be filled by appointment as provided in Section 2.48.030. (Prior code § 3-18)
- 2.48.070 Removal of members.
Any member of the board may be removed by a majority vote of the council when, in the discretion of the council, the best interests of the city will be served. (Prior code § 3-21)
- 2.48.080 Chairperson--Chairperson pro tempore.
The board shall select one of its members as chairperson of the board. In the case of the absence of the chairperson, the members present at any meeting shall select one of the number to act as chairperson pro tempore. (Prior code § 3-22)
- 2.48.090 Meetings.
A. The board shall meet at least once each month, at such time and place as it may fix by resolution.
B. Special meetings of the board may be called at any time by the chairperson, or three members thereof by written notice served upon each member who is in the county at least twenty-four hours before the time specified for the proposed meeting. (Prior code § 3-23)
- 2.48.100 Quorum--Adjournment.
Three (3) members of the board of zoning appeals shall constitute a quorum for the purpose of hearing appeals from the zoning administrator, but a lesser number may adjourn from time to time. (Ord. 5437 § 4, 2005: Ord. 5035 § 1, 1993: prior code § 3-24)
- 2.48.110 Record of proceedings--Secretary.
The board shall cause a record to be kept of all of its proceedings, and for that purpose may select one of its members as secretary. The director of planning shall provide such stenographic assistance as is necessary in keeping the records of the proceedings. (Prior code § 3-25)
- 2.48.120 Powers and duties.
The board shall perform such duties as may be imposed upon it by the council, by ordinance or resolution. (Prior code § 3-26)
- 2.48.130 Procedural rules.
The board may adopt, from time to time, such rules of procedure as it may deem necessary to properly exercise its powers and duties. Such rules shall be subject to approval by the council before becoming effective. All such rules shall be kept on file in the offices of the director of planning and the city clerk, and a copy thereof shall be furnished to any person upon request. (Prior code § 3-27)
